This is a pre-launch draft, shared for transparency while tunejar is in beta and pending final legal review. We'll post the finalised terms before public launch. Your statutory rights as a consumer are not affected by anything below.
These terms are an agreement between you and Paul Hulatt, an individual trader (entrepreneur individuel) established in France, trading as "tunejar" ("we", "us"). By creating an account or using tunejar, you agree to them. Our full company identification is on the legal notice page.
You must be 18 or older and able to enter into a contract. If you use tunejar on behalf of a household or group, you're responsible for their use of it.
tunejar is a collaborative jukebox: a big-screen now-playing display, a phone request page your guests reach via a QR code, and a control panel for you. It controls playback on your own Spotify account — it does not stream or provide any music itself. The service is in beta and still evolving.
tunejar is for personal use in your home or at private gatherings. It is not for commercial or public venues (bars, cafés, shops, clubs, businesses). Playback runs on your own Spotify account, and Spotify's terms permit personal, non-commercial use only — you are responsible for complying with them. Don't use the service in any setting that would breach Spotify's terms or require a commercial music licence.
Keep your login details secure and don't share your account. You're responsible for activity under your account. Give accurate information when you sign up, and keep it current. Tell us promptly if you think your account has been compromised.
You bring your own Spotify Premium account and create your own Spotify app to connect it. You remain responsible for that account and for complying with Spotify's terms. tunejar is not affiliated with, endorsed by, or sponsored by Spotify.
Don't use tunejar to harass others, to play content you're not entitled to play, to break the law, or to interfere with or attempt to gain unauthorised access to the service. We may suspend or remove access for accounts that abuse the service or use it commercially.
Guests choose songs from Spotify's catalogue; the music is provided by Spotify, not by us. Display names and any logo you upload are your responsibility — don't upload anything you don't have the right to use, or that is unlawful or offensive.
You can cancel anytime from your dashboard (via the Stripe billing portal). When you cancel, you keep access until the end of the period you've paid for, followed by a short grace window, after which the account is suspended. Subscription fees are otherwise non-refundable and we don't refund partial periods.
If you're a consumer in the EU, you have a statutory 14-day right of withdrawal (droit de rétractation) on a new purchase. Because tunejar is a digital service supplied immediately, you agree that we may begin providing it during that period; where you ask us to start straight away you may lose that right once the service has been fully performed. Nothing here limits your mandatory statutory rights.
tunejar relies on Spotify, Stripe, Google and Cloudflare. Those services have their own terms, and we're not responsible for their availability or actions. If a third-party service is unavailable, parts of tunejar may not work.
tunejar, including its software, design and brand, belongs to us. We grant you a limited, non-exclusive, non-transferable right to use the service while these terms apply. You don't acquire any ownership in the service.
The service is provided "as is" and "as available" during beta, without warranties of any kind, to the extent permitted by law. We don't guarantee it will be uninterrupted or error-free, and playback depends on Spotify's own availability.
To the extent permitted by law, we are not liable for indirect or consequential losses, or for loss arising from your use of Spotify or other third-party services. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including your mandatory rights as a consumer.
You can stop using tunejar and delete your account at any time. We may suspend or end access if you breach these terms or use the service unlawfully or commercially. You can export your data before deleting your account.
We may update these terms as the service develops. We'll update the "last updated" date and, for material changes, notify account holders. Continuing to use tunejar after a change means you accept the updated terms.
These terms are governed by French law, and the courts of France have jurisdiction — though as a consumer you may also have the right to bring proceedings in the country where you live. Before going to court, you may contact us to try to resolve things. EU consumers can also use the European Commission's Online Dispute Resolution platform.
